Terms & Conditions

These Terms and Conditions govern your (“You”, “you”, “Your”, and “your”) rights and obligations, as users of the portals managed by Turbo Media Limited T/A Diamonds Recharge. Unless otherwise provided by Turbo Media Limited T/A Diamonds Recharge, all new portals introduced and managed by Turbo Media Limited T/A Diamonds Recharge shall be governed by these Terms of Service.

By accessing any of the Portals and/or buying any Items, you acknowledge and accept that your usage of the Portals (or any of them) and purchase of the Items shall be governed by these Terms and Conditions and any other specific rules, procedures, and terms of services as determined by Turbo Media Limited T/A DIAMONDS RECHARGE at any time or from time to time at its absolute discretion.

 

Purchase Process

The process to buy BIGO Diamonds from DIAMONDS RECHARGE is as follows:

1. Buyer selects their desired Items package, the currency of the prices is GBP.

2. Buyer checks out and must provide their primary email address, their billing address, and the Bigo ID of which to process the diamonds order.

3. DIAMONDS RECHARGE will send the purchased amount of diamonds to the Bigo ID as it is provided in the order. The Buyer understands that the diamonds are not recoverable or refundable once delivered.

4. Orders unable to be fulfilled or are rejected, those funds will be returned to the Buyer or cancelled if they were never accepted. DIAMONDS RECHARGE retains the right to reject orders at their sole discretion. 

5. Notwithstanding anything to the contrary herein, DIAMONDS RECHARGE may require one (1) business working day between the date payment in full has been made with respect to the Items and the date in which the Items have been delivered. For clarity, if a purchase of Items is made on Monday, it may take until Tuesday of that week for the Items to have been topped up in the Buyer’s BIGO application account. 

 

Definitions

In these Terms and Conditions, the following words and expression shall have the following meanings unless the context otherwise requires or as otherwise indicated in these Terms of Service:

• Account: means your account registered with the BIGO TECHNOLOGY PTE. LTD. (“BIGO”) application;

• Buyer: means a party who purchases Items on or from the Portals;

• Items: means the goods and services listed for sale on the Portals and “Item” shall mean any one of them, including but not limited to the Virtual Product and services Diamonds which can be used in the BIGO application;

• Parties: means collectively, DIAMONDS RECHARGE and you and “Party” shall mean any one of them;

• Portals: means collectively, the web portals presently known as DIAMONDS RECHARGE, available at diamondsrecharge.com, and such other web portals of DIAMONDS RECHARGE administered and/or managed by DIAMONDS RECHARGE;

• Services: means the services provided by DIAMONDS RECHARGE on the Portals, including, without limitation, the sale of Items;

• Purchased Item(s): means Item(s) listed on the Portals purchased by a Buyer;

• Terms and Conditions: means these Terms and Conditions governing the use of the Services by you as may be amended at any time and from time to time as and when DIAMONDS RECHARGE shall in its absolute discretion deems necessary and shall include: (i) any rules, procedures, and Terms and Conditions as determined by DIAMONDS RECHARGE from time to time; and (ii) any documents, directives, correspondence and agreements referred to in these Terms and Conditions and forming a part hereof, together with any amendments made at any time or from time to time to any of the foregoing.

 

Licence to Use

In consideration of you agreeing to these Terms and Conditions and your continuing observance and compliance of these Terms and Conditions, DIAMONDS RECHARGE hereby grants you a non-exclusive, non-transferable licence to access the Portals and use the Services upon the terms and subject to the Terms and Conditions stated herein.

 

Representations and Warranties

Each time you access the Portals (or any of them), you irrevocably and unconditionally represent and warrant that:

• You are above 18 years old. Should you be less than 18 years old, your parent(s)/guardian(s) are aware and have consented to you accessing the Portals and using the Services;

• Your personal information and the documentation submitted in this respect, including, without limitation, your full name, telephone number, correspondence address and email address, are true and accurate. You shall notify us in writing of any changes in your personal information;

• Save as otherwise permitted by DIAMONDS RECHARGE in writing, you shall not, directly or indirectly, use the Services for any commercial purposes. For clarity you may not resale the Items purchased from the Portals;

• You shall not to use the Portals or the Services (or any of them) to conduct any fraudulent, immoral or illegal activities or such activities, including that may infringe the intellectual property rights of third parties;

• You shall not use any intellectual property belonging to DIAMONDS RECHARGE or BIGO, including, without limitation, trademarks or trade names, whether registered or not, without the prior written consent of DIAMONDS RECHARGE;

• You shall not be disruptive, be offensive or be a nuisance in any manner whatsoever to other users of the Portals or the employees of DIAMONDS RECHARGE;

• You shall not directly or indirectly recruit and/or poach any customers obtained from the usage of the Portals; and

• You shall return any additional Items to DIAMONDS RECHARGE that were sent to you in error upon your receipt of notice indicating the error.

 

Use of Services

You shall procure, at your own costs and expenses, the requisite equipment and software to connect and access the Portals and the ensuing use of the Services. You shall bear all charges and fees imposed by third parties in relation to and in connection with you connecting your equipment to the Portals (or any of them).

It is your primary responsibility to ensure that you are acquainted with the guidelines and procedures for the use of the Services that DIAMONDS RECHARGE may issue from time to time. DIAMONDS RECHARGE shall not be liable for any errors, losses or damages caused by your use of the Services.

It is your responsibility to secure the information of your Account. Any notification or confirmation received by DIAMONDS RECHARGE shall be deemed to have been issued by you notwithstanding that such notification or confirmation may have been issued by a third party, whether authorized or otherwise, and you shall be bound by such notification or confirmation.

DIAMONDS RECHARGE shall not be liable for acting on the notification or confirmation sent through your email. DIAMONDS RECHARGE shall not be obliged to investigate the authenticity or authority of persons affecting the notification or confirmation or verify the completeness of such notification or confirmation. Such notification or confirmation shall be deemed irrevocable and binding on you upon receipt by DIAMONDS RECHARGE notwithstanding any error, fraud, forgery and lack of clarity or misunderstanding in respect of the terms of such notification or confirmation. You shall immediately notify DIAMONDS RECHARGE upon receipt of incomplete, garbled or inaccurate data or information from DIAMONDS RECHARGE. You shall also immediately notify DIAMONDS RECHARGE upon receipt of any data or information which is not intended for you and you shall delete such data or information.

You acknowledge and agree that DIAMONDS RECHARGE may at its absolute discretion refuse or permit you to use the Services without giving any reason or notice thereof.

Unless otherwise permitted by DIAMONDS RECHARGE in writing, you shall not upload, post, email, transmit or otherwise make available any unauthorized or illegal activities on the Portals or directly to other users of the Portals.

You shall not upload, post, email, transmit or in any other manner whatsoever make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunication equipment, including, without limitation, the Portals.

You irrevocably and unconditionally allow and permit DIAMONDS RECHARGE to send to your email updates on services and events offered or provided by DIAMONDS RECHARGE.

 

Payment

You may pay for the Services in such currency that is available on the Portals in accordance with the prevailing exchange rate determined by DIAMONDS RECHARGE at its absolute discretion.

DIAMONDS RECHARGE shall have the absolute discretion to cancel any payment request made by you without assigning any reasons whatsoever.

DIAMONDS RECHARGE shall be entitled to vary or modify or remove the modes of payment available on the Portals (or any of them) at any time without prior notice to you.

You are responsible for any fees, taxes or other costs associated with the purchase and delivery of your Items resulting from charges imposed by your relationship with payment services providers or the duties and taxes imposed by your local customs officials or other regulatory body.

The tax(es) collected on purchases of items sold by DIAMONDS RECHARGE depends on many factors, including the destination of the shipment and the type of item purchased. For taxable purchases, the following tax rates apply based on the province or territory to where the goods are shipped. For digital purchases, it will be the province or territory of the billing or business address, and/or the country of residence to which a device is set:

Generally, tax is calculated on the total selling price of each individual item. Many factors can change between the time you place an order and the time your order is shipped, which could affect the calculation of taxes. Therefore, the amount appearing on your order as “Estimated Tax” can differ from the taxes ultimately calculated when your order ships. In accordance with applicable tax laws, the total selling price of an item generally will include item-level shipping and handling charges, item-level discounts, gift-wrap charges, and an allocation of order-level shipping and handling charges and order-level discounts.

Goods sent to addresses outside the United Kingdom are not subject to TAX, but they can be subject to local taxes and customs charges.

 

All sales are final. There are no returns whatsoever.

 

Availability of Services

The Services are usually available on a daily basis unless otherwise specified herein.

There may be certain times that the Services may not be available due to maintenance or malfunction of the Portals or such other reasons beyond the control of DIAMONDS RECHARGE. 

DIAMONDS RECHARGE makes no warranty that the Services will be available at the times stated herein.

Unless otherwise provided in these Terms and Conditions, DIAMONDS RECHARGE shall be entitled at its absolute discretion, without notice to you, to change the procedures, the mode of operation of the Services at any time and from time to time for any reason whatsoever.

Notwithstanding any provisions to the contrary in these Terms and Conditions, DIAMONDS RECHARGE shall be entitled to: immediately terminate, discontinue, withdraw or suspend your use of the Services without notice; or impose conditions or restrictions on your use of the Service without notice.

 

Limitation on Liability

You agree and confirm that you shall not hold DIAMONDS RECHARGE, its employees, agents or licensees, liable for any special, incidental, consequential or other form of damages arising out of and in relation to the Services or these Terms of Service, including but not limited to BIGO Live application no longer accepting the Items or the value of the Items changing. You hereby expressly disclaim all warranties, express or implied, regarding the Items, including any implied warranty of merchantability, value, use or fitness for a particular purpose.

DIAMONDS RECHARGE DOES NOT WARRANT THAT THE ITEMS WILL MEET YOUR REQUIREMENTS OR THAT THE ITEMS WILL FUNCTION UNINTERRUPTED, ERROR FREE OR AT ALL, OR THAT ALL DEFECTS IN THE ITEMS WILL BE CORRECTED.  IN NO EVENT SHALL DIAMONDS RECHARGE BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE ITEMS, INCLUDING WITHOUT LIMITATION ANY LOSSES EVEN IF DISCOUNT DIAMOND STORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. 

This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

 

Indemnity

You hereby indemnify and hold harmless DIAMONDS RECHARGE and BIGO Live application (and their respective licensees and assigns, and the directors, officers, and agents of the foregoing) from and against any claim, loss, liability, judgment, cost or expense, including reasonable lawyer’s fees, suffered or incurred as a result of or by reason of any breach by you of your obligations, representations or warranties under this Terms of Service, including but not limited to any fraudulent activity related to the purchase of the Items. DIAMONDS RECHARGE reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You shall consult with DIAMONDS RECHARGE upon DIAMONDS RECHARGE’S request with respect to claims. Notwithstanding the foregoing, DIAMONDS RECHARGE decisions regarding any proposed settlements shall be final, and shall not abrogate or diminish Your obligation to indemnify DIAMONDS RECHARGE and BIGO Live application as set forth herein.

Service Provider

All Services offered on the Portals are offered by DIAMONDS RECHARGE, not BIGO Live Application. DIAMONDS RECHARGE is Authorized Official Reseller for BIGO Live Application.

 

Reliability of Portals

You are aware that all transactions conducted on the Portals are through telecommunication and data networks. You are fully aware that your receipt of the notification from DIAMONDS RECHARGE may be delayed or prevented by factors affecting the relevant service providers and other relevant parties. You accept that DIAMONDS RECHARGE cannot guarantee the prompt delivery of such notification or confirmation.

 

Account

You shall immediately notify DIAMONDS RECHARGE if you are aware or believe your Account has been hacked or compromised. You shall be liable for all transactions conducted by You and/or through your Account. You shall follow all of BIGO Live Application’s rules regarding your Account and otherwise. 

Disclosure of Information

DIAMONDS RECHARGE shall be entitled and you irrevocably and unconditionally consent and authorize DIAMONDS RECHARGE to the extent permitted by law, to disclose or release any information pertaining to you or your transactions through the Portals to such extent that DIAMONDS RECHARGE may at its absolute discretion deem fit to:

• such persons as DIAMONDS RECHARGE may be required to disclose under the applicable law;

• such other persons or entity pursuant to any governmental directive or order of the court; or

• any other party whomsoever as DIAMONDS RECHARGE deems fit, including BIGO Live Application.

DIAMONDS RECHARGE Is Registered With The United Kingdom The Data Protection Act 2018 known as GDPR. Your data will not disclose your personal information to any other party without prior notification to you.

 

Applicable Laws and Regulations

Your use of the Services shall be governed by United Kingdom law. BY ENTERING INTO THESE TERMS AND CONDITIONS, YOU EXPRESSLY WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST DIAMONDS RECHARGE, BIGO Live Application OR ANY OTHER PARTY RELATED TO THESE TERMS AND CONDITIONS. Where required, you shall obtain the approval or consent or permission of the relevant regulatory authorities prior to using the Services. For cross-border transactions, you shall not violate the laws existing in the countries involved in the transaction.

 

Suspension, Termination, and Cancellation of Services

The Services (or any part thereof) may be cancelled by DIAMONDS RECHARGE at any time without prior notice to you. After cancellation, the Services (or any part thereof) may be reinstated in such manner and on such Terms and Conditions as DIAMONDS RECHARGE may at its absolute discretion determine.

DIAMONDS RECHARGE reserves the right at all times to suspend or block access to and use of the Services (or any part thereof) for any reason whatsoever and for any duration of time and upon any conditions that DIAMONDS RECHARGE may at its absolute discretion determine.

Upon cancellation or termination of the Services (or any part thereof):

• you shall immediately pay to DIAMONDS RECHARGE all outstanding fees and charges due and owing to DIAMONDS RECHARGE;

• DIAMONDS RECHARGE may at its absolute discretion, decide not to act on any request received by DIAMONDS RECHARGE after the effective date of termination;

• DIAMONDS RECHARGE may at its absolute discretion, decide not to act on any confirmation or request received by DIAMONDS RECHARGE between the date of notice is given to you and the effective date of termination (if there is a lapse of time between the two dates); and

• you hereby irrevocably and unconditionally authorize DIAMONDS RECHARGE to deduct all money due and owing by you to DIAMONDS RECHARGE (if any) from the moneys that are payable by DIAMONDS RECHARGE to you in respect of the Items.

Suspension of your access to the Services and Items is in addition to and not in lieu of any rights and remedies available to DIAMONDS RECHARGE under these Terms of Service or any applicable law.

FOR GREATER CERTAINTY, ANY INDEMNIFICATION, WARRANTIES AND LIMITATIONS OF LIABILITY UNDER THE TERMS AND CONDITIONS REMAIN IN EFFECT FOLLOWING ANY CANCELLATION, TERMINATION, RESTRICTION OR SUSPENSION OF YOUR ACCESS TO THE SERVICES OR ITEMS. THIS AGREEMENT WILL TERMINATE AUTOMATICALLY IF YOU FAIL TO COMPLY WITH ITS TERMS OF SERVICES. IN SUCH EVENT, YOU MUST CEASE AND DESIST FROM ACCESSING ANY ITEMS. 

 

Notices

All notices and documents required to be given by you under these Terms and Conditions to DIAMONDS RECHARGE shall be sent to info@diamondsrecharge.com or any manner of notification as DIAMONDS RECHARGE may at its absolute discretion determine. Any notice or document or communication given by DIAMONDS RECHARGE to you shall be deemed to be served and received by you on the day following the sending of such notice or document.

 

Waiver and Severance

Any failure by DIAMONDS RECHARGE to enforce at any time or for any period any one or more of these Terms and Conditions shall not be a waiver of them or of the right at any time subsequently to enforce these Terms and Conditions. In the event that any provisions of these Terms and Conditions is declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable DIAMONDS RECHARGE shall amend that provision in such reasonable manner as would achieve the intention of DIAMONDS RECHARGE or at the discretion of DIAMONDS RECHARGE it may be severed from these Terms and Conditions and the remaining provisions remain in full force and effect.

 

Variation

These Terms and Conditions may be modified, added to, deleted or varied by DIAMONDS RECHARGE by way of posting on the Portals or in any such other manner as DIAMONDS RECHARGE may in its absolute discretion determine including amending the link on DIAMONDS RECHARGE’S website. You agree that continued use of the Services shall constitute your acceptance of these Terms and Conditions (as modified and varied from time to time).

 

Assignment

You may not assign rights under these Terms of Service without the prior written consent of DIAMONDS RECHARGE.

 

Binding Effect

These Terms and Conditions shall be binding on your heirs, personal and legal representatives, estate, successors-in-title and permitted assigns (where applicable) you.

 

Inspections

DIAMONDS RECHARGE reserves the right to investigate you if DIAMONDS RECHARGE suspects you have violated these Terms and Conditions and/or any applicable laws. DIAMONDS RECHARGE may seek to gather information from you or about your use of the Items in furtherance of this purpose. If DIAMONDS RECHARGE believes, in its sole discretion, that a violation of these Terms and Conditions and/or any applicable laws has occurred, DIAMONDS RECHARGE may take any corrective action deemed appropriate, including providing personally identifiable information as part of any legal process.

BY ACCEPTING THESE TERMS OF SERVICE, YOU WAIVE AND HOLD HARMLESS DIAMONDS RECHARGE FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY DIAMONDS RECHARGE IN GOOD FAITH DURING OR AS A RESULT OF ITS INVESTIGATIONS OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY DIAMONDS RECHARGE.

 

Equitable Remedies

Violation of these Terms and Conditions may result in irreparable damage to DIAMONDS RECHARGE. DIAMONDS RECHARGE shall be entitled, without bond, other security or proof of damages to equitable remedies (such as injunctive relief) with respect to your breach of any of these Terms and Conditions. This in no way limits DIAMONDS RECHARGE rights to claim additional available remedies.

 

Further Instruments

You agree to execute such further instruments and to take such further action as may reasonably, in DIAMONDS RECHARGE discretion, be necessary to carry out the intent of these Terms and Conditions.

 

BIGO Live Application

You shall abide by all regulations and policies of BIGO Live Application, Guidelines, Rules, Terms And Conditions ;
